First practical fact most San Bernardino County heirs learn: since early 2024, probate isn’t heard at the downtown Justice Center. Decedents’ estates are filed and heard in Fontana, or Victorville for the High Desert, and the examiner’s “probate notes” on your petition post to the court’s portal two weeks before the hearing. Clear those notes early and the estate moves; ignore them and the hearing continues to a later date, which is how six months becomes ten.

Since February 2024, probate isn’t heard in downtown San Bernardino at all: decedents’ estates are filed and heard at the Fontana and Victorville districts. Probate notes, the examiner’s to-fix list for your petition, post to the court’s online portal two weeks before the hearing, and clearing them before the date is the difference between one hearing and three.

The housing stock

The valley floor tells its age in decades: prewar and postwar bungalows in central San Bernardino and older Redlands, 1960s–70s ranches through Highland and the mid-city, and 1980s-onward tract across Fontana and Rancho Cucamonga. The older half is where inspection findings cluster: galvanised supply lines, aluminium branch wiring from the late ’60s and ’70s, and Federal Pacific panels that insurers increasingly refuse outright.

What kills deals here

In the High Desert (Phelan, Piñon Hills, the unincorporated fringe), water and waste are private: wells, septic tanks, and a county health department that wants a percolation test on file before a septic permit moves. Financed buyers routinely lose weeks to well tests and septic certifications, which is why cash matters more up there than down the hill. On the valley floor it’s the older-stock trio above (plumbing, wiring, panels) that resets buyers’ numbers at inspection.

Recording a deed

The Assessor–Recorder–Clerk records at the Hall of Records in San Bernardino, publishes a fee calculator, and supports same-day e-recording through authorised submitters, which in an ordinary escrow means the deed records the day of closing. Budget for the state’s $75-per-document Building Homes and Jobs Act fee on non-sale recordings; it surprises people doing family transfers.

The estate house, valley and desert editions

The valley-floor estate house is the county’s old stock in concentrate: a Redlands or San Bernardino bungalow owned since the ’70s, original wiring and plumbing, and forty years of contents. Heirs get quoted renovation numbers that assume a live-in owner’s patience. We quote as-is and take the contents question off the table entirely.

The High Desert estate house adds infrastructure: well, septic, maybe a parcel line nobody ever surveyed. Out-of-town heirs underestimate how much these complicate a financed sale (well tests, septic pump-and-certify, county health paperwork), and overestimate what the market pays for acreage. We’ve bought both editions; the honest number comes with the reasoning attached.

One more thing heirs here run into: the family house often secured the family’s other obligations: a reverse mortgage, a HELOC from 2006, sometimes an old judgment lien nobody mentioned. None of these stop a sale; all of them come out of the proceeds through escrow. Pull a preliminary title report early. We’ll arrange it at no cost, so the estate plans from the real number rather than the imagined one.

The single biggest fork in any California probate sale is the representative’s authority. Full authority under the Independent Administration of Estates Act usually means the representative can sell with notice to the heirs and no court hearing; limited authority means the sale is confirmed in court, which adds weeks and an overbid step. It’s printed on the Letters. Look before you plan, and if probate hasn’t been opened yet, tell your attorney you’d like full authority requested. It routinely saves an estate a month or more.
